The Importance of Contracts in the Construction Industry

By Michael Emerzidis

As someone who has worked in civil construction and the building industry for almost two decades, I can tell you from experience that having a solid contract in place is absolutely crucial when it comes to securing work & coming out on top at the end. Without a contract, you’re leaving yourself open to all sorts of mishaps and misunderstandings that can quickly lead to financial trouble and even liquidation.

One of the biggest benefits of having a contract is that it provides clarity and protection for both parties. With a contract in place, you and your client can clearly outline your expectations, responsibilities, and obligations. This not only helps to prevent disputes from arising in the first place, but it also provides a clear framework for resolving any issues that do come up.

Another key benefit of having a contract is that it helps to establish trust between you and your client. When you both know exactly what to expect from each other, it creates a sense of security and stability that can help to foster a long-term working relationship. This is especially important in an industry like construction, where projects can often take months or even years to complete.

That being said, I know that sometimes it can be difficult to know where to turn for help when things go wrong. Many contractors are reluctant to seek outside assistance, either because they’re afraid of appearing weak or because they don’t want to spend money on legal fees. But the truth is that there is help available if you need it. Whether you’re dealing with a contract dispute, a payment issue, or any other kind of problem, there are professionals out there who can help you to navigate the situation and protect your interests.

In conclusion, securing work with a contract in place is absolutely essential if you want to avoid the kind of financial trouble that can lead to liquidation. By taking the time to establish clear expectations and obligations with your clients, you can help to prevent disputes from arising and build trust that will last for years to come. And if you do find yourself in a difficult situation, don’t be afraid to seek help from a professional. It’s always better to address problems early on, rather than waiting until it’s too late.

Here are 5 tips on what contractors should be doing to protect themselves.

  1. Get Everything in Writing: Whether it’s a contract, change order, or payment agreement, make sure everything is documented in writing. This will help to establish clear expectations and reduce the risk of misunderstandings or disputes. (This means no more handshake deals)
  2. Review Contracts Carefully: Before signing any contract, take the time to review it carefully and make sure you understand all of the terms and conditions. If there’s anything you’re unsure about, don’t hesitate to seek the advice of an expert.
  3. Keep Records of Everything: From invoices to receipts to communication with clients, make sure you keep accurate and detailed records of all aspects of your business. This will be invaluable if you ever need to prove your case in a dispute or legal action.
  4. Stay Up to Date on Regulations: The construction industry is highly regulated, and rules and regulations are constantly changing. Stay informed about any changes that may affect your business, and make sure you’re in compliance with all relevant laws and regulations.
  5. Invest in Insurance: Accidents and unforeseen events can happen, even to the most careful and experienced contractors. Protect yourself and your business by investing in insurance, including liability insurance, workers’ compensation insurance, and property insurance.
